TRADEMARK OPPOSITION
WHAT IS TRADEMARK OPPOSITION?
Trademark opposition occurs at a later stage of the trademark registration process after the trademark examiner approves the trademark. Once the trademark has been advertised in the trademark journal, the opposition period is opened for a period of 4 months.
This is done to maintain the transparency of the process so that if
any person has an objection to the trademark, they can be heard in
an opposition hearing as per section 21 of the Trademarks Act. This period begins from the day the Trademark is published in the trademarks journal. If no trademark opposition is filed within this
period the trademark is registered. There is no requirement for the
third party who opposes the trademark to be a proprietor, but can also be a consumer/purchaser. This is because similar trademarks may confuse and deceive the public and a consumer may represent the public at large.

- Power of attorney so that a professional can file the trademark opposition on your behalf
- Affidavit with information about the trademark; with the user date and proof of use
- Details about the mark you want to oppose
