SHOP AND ESTABLISHMENT REGISTRATION
WHAT IS SHOPS AND ESTABLISHMENT REGISTRATION?
One of the primary objectives of registering under the Shops and
Establishments Act is to regulate and maintain a record of places of business and employees at a regional and state level. This is carried
out to expedite several processes and make easy the operation of such establishments without much unwanted interference. It is also put in place to provide the employees with certain benefits which are
uniform all across that region, according to that state’s Shops and Establishments Act.
WHAT IS THE PURPOSE OF THE SHOP
AND ESTABLISHMENT LICENSE?
Workers in the unorganised sector don’t have any other governing body to ensure that their rights and working conditions are as they should be. This is the rationale for implementing the Shop Act License. Although the principles of the Shop/Trade License
vary from one state to another, it brings consistency within a given area – in terms of leaves given, work hours, payments, etc.

The Shop and Establishment Act regulates the functioning of companies wherein any trade is administered. Not only does this apply to commercial establishments but also to charitable trusts, profit-run educational institutions and other premises having
a brokerage, stock or insurance activities administered. Some of the areas that fall into the regulations of the Shop and Establishments Act are the remainder interval for workers, opening and shutting hours, maternity leave, sick and causal
leave alongside rules regarding overtime work, national and religious holidays, and so on.

WHO ALL COME UNDER THE SHOP AND ESTABLISHMENT ACT?
A shop is essentially any premise where retail or wholesale goods are sold or services are provided to people. Under this banner, the following establishments fall under the Shop and Establishments Act:

Residential hotels

Theatre and other places of public entertainment
APPLICABILITY
Each state has its own Shops and Establishments Act. For the majority of the states, each shop and establishment is required to register itself within 30 days of commencement of business. All premises
need to obtain this registration except those which fall under the purview of the Factories Act, 1948.
WHY REGISTER A SHOP OR ESTABLISHMENT?
Expedited Inspections
A registration under the Act expedites the regular inspections conducted by local municipalities and the state government.
Having the appropriate license helps avoid unnecessary delay and/or any such
potential issues.
Proof of Existence of Shop or Establishment
Each shop or an establishment requires a
proof of its existence and place of operation.
In addition, it also affirms the right to conduct business in that particular place for which it
is registered.
Government Benefits
Each state has District Industries Centers (DICs) which provide valuable assistance and solutions to local and small entrepreneurs who have just started
out. This is put in place to promote regional cottage and small industries. So, on the basis of the relevant Shops or Establishment license, one can avail these benefits.
Bank Account
Nearly each bank requires a proof of establishment to enable opening of a bank account. In addition, each shop or establishment is mandated to link separate accounts for separate businesses, as per
RBI compliance.
