WHAT IS PROPERTY REGISTRATION?

Property Registration in India is compulsory under section 17 of the Indian Registration Act, 1908.


Registration of the property may be a full and final agreement signed between two parties. Once a property is registered, it means the property buyer in whose favor the property is registered is the lawful owner of the premises who is fully responsible for it in all respects. Unregistered owners are not recognized by the law and the law does not give unrecognized owners any rights over the property. Therefore, Registration of Property is Compulsory to stop fraud or future litigation.


Whenever a property buyer buys a bit of land/immovable property, he/she must register an equivalent with the authority concerned. Once a property is registered, the property buyer in whose favor the property is registered becomes the lawful owner of the premises and is held responsible for it in all aspects. The registration of Sale deed enables an individual to accumulate the rights of the property on the date of execution of the deed.

Documents Required:

  • Identity proof of parties involved (Aadhar Card,PAN card etc.)

  • Two passport photographs of parties involved

​

  • Sale deed

​

  • Power of authority in case the party is representing someone else.

​

  • If the party is a company then power of attorney/letter of authority, along with a copy of the resolution of the company’s board, authorizing him to carry out the registration, certificate of incorporation.

  • Property card

​

  • Proof of payment of stamp duty and registration fee

​

  • Copy of No objection certificate under the land ceiling Act.

​

  • Copy of Municipal tax bill

​

  • Construction completion certificate.

​

  • In case the property is/was under a lease from D.D.A., L&DO, M.C.D., Industries Department, Labour Department of Delhi Govt. etc., the permission of lessor for registration of the document.

​

  • No objection Certificate under section 8 of Delhi Land (Restriction and Transfer) Act, 1972 from Tehsildar of the Sub Division of the District to the effect that the property is not under acquisition.
